They contain important information about your rights and obligations as a customer. Please read these General Terms and Conditions carefully before placing an order.

In these General Terms and Conditions, the following terms have the following meanings:

Website: the website of THIS IS HARDSTYLE, available at thisishardstyle.com, including all of its subdomains.

Client: a natural person acting for purposes outside their profession or business who enters into an agreement with THIS IS HARDSTYLE and/or registers on the Website.

Agreement: any arrangement or agreement between THIS IS HARDSTYLE and the Client of which these General Terms and Conditions form an integral part.

3. Applicability of the General Terms and Conditions

3.1. These General Terms and Conditions apply to all offers, agreements and deliveries made by THIS IS HARDSTYLE, unless explicitly agreed otherwise in writing.

If the Client includes provisions in an order, confirmation or other communication that differ from or are not included in these General Terms and Conditions, such provisions will only be binding upon THIS IS HARDSTYLE if and to the extent that THIS IS HARDSTYLE has expressly accepted them in writing.

4. Prices and Information

4.1. All prices displayed on the Website and in other materials originating from THIS IS HARDSTYLE are stated in euros and include applicable taxes and government-imposed levies, unless expressly stated otherwise.

4.2. If shipping costs apply, these will be clearly communicated to the Client before the Agreement is concluded. Shipping costs will also be displayed separately during the ordering process.

4.4. Prices and other information displayed on the Website are subject to obvious programming, typing and other apparent errors.

5. Conclusion of the Agreement

5.1. The Agreement is concluded when the Client accepts an offer from THIS IS HARDSTYLE and fulfils the applicable conditions.

5.2. If the Client accepts the offer electronically, THIS IS HARDSTYLE will confirm receipt of the acceptance electronically without undue delay.

5.3. Until receipt of this confirmation has been acknowledged, the Client may cancel the Agreement.

5.4. If the Client provides incorrect or incomplete information when placing an order or entering into the Agreement, THIS IS HARDSTYLE may require the Client to fulfil their obligations based on the correct information.

5.5. THIS IS HARDSTYLE reserves the right to refuse orders placed by persons acting in the course of a profession or business.

6. Registration and Account

6.1. To make full use of certain features of the Website, the Client may register by completing the registration form or using the account sign-in option.

6.2. During registration, the Client may be asked to choose a username and password. The Client is responsible for choosing a sufficiently secure password.

6.3. The Client must keep their login credentials strictly confidential.

6.4. The Client is responsible for all activity carried out through their account using their login credentials, unless the Client has notified THIS IS HARDSTYLE that their credentials have been compromised.

6.5. If the Client knows or suspects that their login details have become available to an unauthorised person, the Client must change their password as soon as possible and notify THIS IS HARDSTYLE so that appropriate measures can be taken.

7. Delivery and Execution of the Agreement

7.1. After receiving an order, THIS IS HARDSTYLE will process and dispatch the order within the applicable delivery period.

7.2. THIS IS HARDSTYLE may engage third parties to fulfil its obligations under the Agreement.

7.3. Before the Agreement is concluded, the Website will clearly state how and within what period the products will be delivered.

7.4. If no delivery period has been agreed or stated, the products will be delivered without undue delay and, in any event, within 30 days after the Agreement has been concluded, unless a different period has been agreed with the Client.

7.5. If THIS IS HARDSTYLE is unable to deliver within the agreed delivery period, the Client will be informed as soon as possible. Where legally applicable, the Client may cancel the Agreement and receive a refund of amounts already paid.

7.6. THIS IS HARDSTYLE recommends that the Client inspect the products upon delivery and report any defects as soon as reasonably possible, preferably in writing or by email.

7.7. The risk of loss or damage to the products passes to the Client when the products have been delivered to the Client or to a third party designated by the Client, unless mandatory law provides otherwise.

7.8. If an ordered product is no longer available, THIS IS HARDSTYLE may, where legally permitted, offer a comparable product of similar nature and quality. The Client will have the right to reject such an alternative and, where applicable, cancel the Agreement without additional costs.

8. Right of Withdrawal

8.1. If the Client is a consumer, the Client has the statutory right to withdraw from a distance contract within 14 calendar days without giving a reason if the book is still in the original plastic packaging.

8.2. For products, the withdrawal period begins on the day after the Client, or a third party designated by the Client, receives the product.

8.3. The Client may exercise the right of withdrawal by informing THIS IS HARDSTYLE of their decision within the withdrawal period. The Client may also use the applicable withdrawal form made available by THIS IS HARDSTYLE.

8.4. After notifying THIS IS HARDSTYLE of the withdrawal, the Client must return the product without undue delay and, in any event, within 14 days after communicating the withdrawal, unless otherwise agreed.

8.5. The Client is responsible for the direct costs of returning the product, provided that THIS IS HARDSTYLE has informed the Client of this obligation before the purchase.

8.6. THIS IS HARDSTYLE will refund the payments received from the Client, including the standard delivery costs paid for the original order, without undue delay and in any event within 14 days after the Client has notified THIS IS HARDSTYLE of the withdrawal.

8.7. THIS IS HARDSTYLE may delay the refund until the returned product has been received or until the Client provides evidence that the product has been returned, whichever occurs first.

8.8. If the Client selected a more expensive delivery method than the standard delivery option offered by THIS IS HARDSTYLE, any additional delivery costs will not be refunded.

8.9. During the withdrawal period, the Client must handle the product and its packaging with reasonable care. The Client may inspect and handle the product only to the extent necessary to establish its nature, characteristics and functioning, in a manner that would normally be permitted in a physical store.

8.10. The Client may be liable for any diminished value resulting from handling the product beyond what is reasonably necessary to establish its nature, characteristics and functioning.

9. Exceptions to the Right of Withdrawal

The statutory right of withdrawal does not apply to products for which an exception under applicable law applies.

This may include, for example, products that are made according to the Client's specifications or clearly personalised for the Client, where the applicable legal requirements for such an exception are met.

If an exception applies to a particular product, THIS IS HARDSTYLE will clearly inform the Client before the purchase is completed.

10. Payment

10.1. The Client must pay the amounts due to THIS IS HARDSTYLE using one of the payment methods made available during the ordering process.

10.2. THIS IS HARDSTYLE may determine which payment methods are offered and may change the available payment methods from time to time.

11. Legal Guarantee and Conformity

11.1. THIS IS HARDSTYLE guarantees that the products supplied conform to the Agreement, the specifications stated in the offer and the reasonable requirements of soundness, usability and conformity applicable under Dutch law.

11.2. The statutory rights of the Client are not affected by any commercial warranty offered by THIS IS HARDSTYLE, a manufacturer or an importer.

11.3. If a product does not conform to the Agreement or has a defect, the Client should notify THIS IS HARDSTYLE within a reasonable period after discovering the issue.

11.4. If a complaint is found to be justified, THIS IS HARDSTYLE will provide the remedy required by applicable law. Depending on the circumstances, this may include repair, replacement, price reduction or a refund.

11.5. Nothing in these General Terms and Conditions limits the statutory rights of the Client.

12. Complaints

12.1. If the Client has a complaint concerning a product or the services of THIS IS HARDSTYLE, the Client may submit the complaint by email, telephone or post using the contact details below.

12.2. THIS IS HARDSTYLE will respond to a complaint as soon as reasonably possible and, in any event, within 7 days of receiving the complaint.

12.3. If a substantive response cannot be provided within 7 days, THIS IS HARDSTYLE will confirm receipt of the complaint and indicate when the Client can expect a substantive response.

13. Personal Data

14. Final Provisions

14.1. These General Terms and Conditions are governed by Dutch law, without prejudice to any mandatory consumer protection provisions that apply to the Client.

14.2. Any dispute arising from an Agreement will, insofar as permitted by mandatory law, be submitted to the competent court in the Netherlands.

14.3. If any provision of these General Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14.4. THIS IS HARDSTYLE and the Client will replace the invalid or unenforceable provision with a valid provision that reflects the original intention as closely as legally possible.

14.5. Where these General Terms and Conditions refer to communication "in writing", this includes communication by email where the identity of the sender and the integrity of the communication can reasonably be established.
