In these General Terms and Conditions, the following terms have thefollowing meanings:

Website: the website of THIS IS HARDSTYLE, available at thisishardstyle.com,including all of its subdomains.
Client: a natural person acting for purposes outside their profession orbusiness who enters into an agreement with THIS IS HARDSTYLE and/or registerson the Website.
Agreement: any arrangement or agreement between THIS IS HARDSTYLE and the Client ofwhich these General Terms and Conditions form an integral part.

3. Applicability of the General Termsand Conditions

5. Conclusion of the Agreement
5.1. The Agreement is concluded when the Client accepts an offer fromTHIS IS HARDSTYLE and fulfils the applicable conditions.
5.2. If the Client accepts the offer electronically, THIS IS HARDSTYLEwill confirm receipt of the acceptance electronically without undue delay.
5.3. Until receipt of this confirmation has been acknowledged, the Clientmay cancel the Agreement.
5.4. If the Client provides incorrect or incomplete information whenplacing an order or entering into the Agreement, THIS IS HARDSTYLE may requirethe Client to fulfil their obligations based on the correct information.
5.5. THIS IS HARDSTYLE reserves the right to refuse orders placed bypersons acting in the course of a profession or business.
6. Registration and Account

6.2. During registration, the Client may be asked to choose a usernameand password. The Client is responsible for choosing a sufficiently securepassword.
6.3. The Client must keep their login credentials strictly confidential.
6.4. The Client is responsible for all activity carried out through theiraccount using their login credentials, unless the Client has notified THIS ISHARDSTYLE that their credentials have been compromised.
6.5. If the Client knows or suspects that their login details have becomeavailable to an unauthorised person, the Client must change their password assoon as possible and notify THIS IS HARDSTYLE so that appropriate measures canbe taken.
7. Delivery and Execution of theAgreement
7.1. After receiving an order, THIS IS HARDSTYLE will process anddispatch the order within the applicable delivery period.
7.2. THIS IS HARDSTYLE may engage third parties to fulfil its obligationsunder the Agreement.
7.3. Before the Agreement is concluded, the Website will clearly statehow and within what period the products will be delivered.
7.4. If no delivery period has been agreed or stated, the products willbe delivered without undue delay and, in any event, within 30 days after theAgreement has been concluded, unless a different period has been agreed withthe Client.
7.5. If THIS IS HARDSTYLE is unable to deliver within the agreed deliveryperiod, the Client will be informed as soon as possible. Where legallyapplicable, the Client may cancel the Agreement and receive a refund of amountsalready paid.
7.6. THIS IS HARDSTYLE recommends that the Client inspect the productsupon delivery and report any defects as soon as reasonably possible, preferablyin writing or by email.
7.7. The risk of loss or damage to the products passes to the Client whenthe products have been delivered to the Client or to a third party designatedby the Client, unless mandatory law provides otherwise.
7.8. If an ordered product is no longer available, THIS IS HARDSTYLE may,where legally permitted, offer a comparable product of similar nature andquality. The Client will have the right to reject such an alternative and,where applicable, cancel the Agreement without additional costs.
8. Right of Withdrawal
8.1. If the Client is a consumer, the Client has the statutory right towithdraw from a distance contract within 14 calendar days without giving areason if the book is still in the orignal plastic packaging.
8.2. For products, the withdrawal period begins on the day after theClient, or a third party designated by the Client, receives the product.
8.3. The Client may exercise the right of withdrawal by informing THIS ISHARDSTYLE of their decision within the withdrawal period. The Client may alsouse the applicable withdrawal form made available by THIS IS HARDSTYLE.
8.4. After notifying THIS IS HARDSTYLE of the withdrawal, the Client mustreturn the product without undue delay and, in any event, within 14 days aftercommunicating the withdrawal, unless otherwise agreed.
8.5. The Client is responsible for the direct costs of returning theproduct, provided that THIS IS HARDSTYLE has informed the Client of thisobligation before the purchase.
8.6. THIS IS HARDSTYLE will refund the payments received from the Client,including the standard delivery costs paid for the original order, withoutundue delay and in any event within 14 days after the Client has notified THISIS HARDSTYLE of the withdrawal.
8.7. THIS IS HARDSTYLE may delay the refund until the returned producthas been received or until the Client provides evidence that the product hasbeen returned, whichever occurs first.
8.8. If the Client selected a more expensive delivery method than thestandard delivery option offered by THIS IS HARDSTYLE, any additional deliverycosts will not be refunded.
8.9. During the withdrawal period, the Client must handle the product andits packaging with reasonable care. The Client may inspect and handle theproduct only to the extent necessary to establish its nature, characteristicsand functioning, in a manner that would normally be permitted in a physicalstore.
8.10. The Client may be liable for any diminished value resulting fromhandling the product beyond what is reasonably necessary to establish itsnature, characteristics and functioning.
9. Exceptions to the Right ofWithdrawal
The statutory right of withdrawal does not apply to products for which anexception under applicable law applies.
This may include, for example, products that are made according to theClient's specifications or clearly personalised for the Client, where theapplicable legal requirements for such an exception are met.
If an exception applies to a particular product, THIS IS HARDSTYLE willclearly inform the Client before the purchase is completed.
10. Payment
11.1. The Client must pay the amounts due to THIS IS HARDSTYLE using oneof the payment methods made available during the ordering process.
11.2. THIS IS HARDSTYLE may determine which payment methods are offeredand may change the available payment methods from time to time.
11. Legal Guarantee and Conformity
12.1. THIS IS HARDSTYLE guarantees that the products supplied conform tothe Agreement, the specifications stated in the offer and the reasonablerequirements of soundness, usability and conformity applicable under Dutch law.
12.2. The statutory rights of the Client are not affected by anycommercial warranty offered by THIS IS HARDSTYLE, a manufacturer or animporter.
12.3. If a product does not conform to the Agreement or has a defect, theClient should notify THIS IS HARDSTYLE within a reasonable period afterdiscovering the issue.
12.4. If a complaint is found to be justified, THIS IS HARDSTYLE willprovide the remedy required by applicable law. Depending on the circumstances,this may include repair, replacement, price reduction or a refund.
12.5. Nothing in these General Terms and Conditions limits the statutoryrights of the Client.
12. Complaints

13.2. THIS IS HARDSTYLE will respond to a complaint as soon as reasonablypossible and, in any event, within 7 days of receiving the complaint.

15.3. If any provision of these General Terms and Conditions is found tobe invalid or unenforceable, the remaining provisions will remain in full forceand effect.
15.4. THIS IS HARDSTYLE and the Client will replace the invalid orunenforceable provision with a valid provision that reflects the originalintention as closely as legally possible.
15.5. Where these General Terms and Conditions refer to communication"in writing", this includes communication by email where the identityof the sender and the integrity of the communication can reasonably beestablished.
